EXPERIENCE

Automotive

Mr. Bishoff’s expertise in the automotive industry centers on warranty and recall matters, troubled supplier litigation, contract and UCC matters, and automobile dealer and franchise disputes. He has prosecuted and defended some of the largest recall cases in the U.S. and Michigan and frequently works with clients in connection with root cause and government investigations to assess and mitigate risk. He is a frequent author of articles concerning the automotive supply chain and has litigated numerous supply disputes to a successful resolution for his clients. Mr. Bishoff also frequently advises and counsels automotive clients on contractual and supply chain matters. In addition, he has handled automotive dealer and franchise disputes and importation and distribution matters throughout the United States and Europe.

Business & Commercial Litigation

In addition the practice areas noted above, Mr. Bishoff has experience in business disputes for both plaintiffs and defendants, at trial and appellate levels of state and federal courts, as well as arbitration and other forms of alternative dispute resolution, in many areas, including:

  • General commercial, contract and UCC disputes
  • Fraud, tortious interference, business defamation and other business torts
  • Manufacturer sales representative disputes
  • Non-compete agreements, with particular emphasis on specialized manufacturing processes
  • Class actions, including environmental and ERISA stock drop actions
  • Employment severance disputes

Healthcare & Insurance

Mr. Bishoff’s expertise in the health care industry arises from his representation of managed care organizations, HMOs, and third-party administrators. He has successfully represented health care insurers in coverage, policy and other commercial litigation matters. He successfully defended one of the nation’s largest health care companies in a dispute with a Michigan-based HMO arising out of the administration of the HMO’s business operations.

Construction

Mr. Bishoff has represented contractors, construction managers, architects, and engineers in some of the largest construction projects in Southeast Michigan. He successfully resolved litigation involving the main electrical contractor involved in the construction of the McNamara Terminal at Detroit Metropolitan Wayne County Airport. He also successfully represented the construction manager in a dispute arising out of the construction of the UAW-GM Center for Human Resources, located along the Detroit River. Mr. Bishoff also successfully represented the architect/engineers of the Wayne County Justice Center project in Downtown Detroit.

Mediation & Arbitration

Mr. Bishoff regularly serves as a mediator and arbitrator of commercial and automotive related disputes of other parties. Based on his experience and recognition as a leading practitioner, Mr. Bishoff has been asked by his peers to serve as a mediator and arbitrator of disputes involving breach of contract, automotive recalls and warranty disputes, U.C.C. sales disputes, automotive supply disputes, general business disputes, and other commercial matters.
